"blood alcohol legal limit answer was .08 but .08 is illegal fix your test "
Ryan T. - Kern, California
School Reply: Hello Ryan,
Thank you for your input, Ryan. The legal limit is .08 and meaning that is the limit. The limit .08 is what is called the legal limit according to the law. I know it is confusing for most as they hear it as, "a DUI is .08 and you are considered legally intoxicated" and it seems it should be called the illegal limit, however, the .08 is the legal limit and not .079^ or .081. In all, it is the defining line of that limit. Also, so you are not confused about what constitutes being arrested for a DUI, you can be arrested for a DUI with lower than .08. A reading between a .05 and .07 an officer can determine a DUI arrest based on observations; for example, you fail a field sobriety test or you can't stand up. So, it is presumed you are intoxicated.
I hope this clarifies this for you. Please feel free to confirm with your local Highway Patrol.
In all, from our course, I hope you realized that it is never a good idea to drink any level of alcohol and drive. An observant and coherent driver is what keeps are roads safe. Happy safe driving.
Again, thank you for your input.
